   Despite this prohibition, information provided by other Geavity.com Members (for instance, in their Profile) may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services, and Geavity.com assumes no responsibility or liability for this material.
   
   If you are aware of misuse of the Geavity Services by any other member, please contact abuse@Geavity.com or click on the "Report Abuse" link at the bottom of any Geavity.com page.
   
   In the event that you choose to reveal and disclose your personal contact information and other details to other members and visitors of Geavity.com Members via Geavity.com's services, you do so at your own personal risk. Geavity.com assumes no responsibility nor liability as a result of this disclosure. You hereby agree to indemnify and hold blameless Geavity.com and any of its partners, agents, affiliates, third party providers or content providers from any liabilty including claims for any personal safety, injury or death suffered by you as a result of the disclosure.
   
   
   
4. RIGHT FOR REMOVAL/REFUSAL/TERMINATION
   
   Geavity.com reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages, illustrations and images) by you, or to restrict, suspend, or terminate your access to all or any part of the Geavity Services at any time, for any or no reason, with or without prior notice, and without liability.
   
   Geavity expressly reserves the right to remove your profile and/or restrict, suspend, or terminate your access to any part of Geavity services if Geavity determines, in its sole discretion, that you pose a threat to Geavity and/or its members or visitors.

   Geavity provides links to third-party sites as a convenience to you. Geavity does not control third party sites or links to third party sites. Links to third-party sites are not an endorsement by Geavity of such sites. Geavity is not responsible for the content of any linked sites.
   
   
   
6. WARRANTIES
   
   You represent and warrant that:
   (i) you are above 18 years of age and have the legal capacity to accept these Terms of Use.
   (ii) you own the Content posted by you on Geavity.com or otherwise have the right to post the Content to Geavity.com, and
   (iii) the posting of your Content on or through the Geavity website does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content posted by you to or through Geavity.
   
   
   
7. LIMITATION OF LIABILITY
   
   NEITHER Geavity NOR ANY OF ITS PARTNERS, AGENTS, AFFILIATES, THIRD PARTY PROVIDERS OR CONTENT PROVIDERS SHALL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY FORM OF DAMAGES (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES) ARISING OUT OF OR RELATED TO THE USE OR ATTEMPTED USE OF THE SITE, OR ANY EXTERNAL WEB SITES LINKED TO THIS SITE, OR THE MATERIALS ON THE SITE, HOWEVER ARISING, WHETHER FOR BREACH OR IN TORT, EVEN IF Geavity WAS INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.
   
   
   
8. INDEMNIFICATION
   
   You agree to indemnify and hold Geavity harmless from, and against, all claims, expenses or liability asserted against Geavity arising out of or in connection with any breach of any of the terms of this Agreement.
   
   
   
9. JURISDICTION
   
   This Agreement constitutes the entire agreement between You and Geavity regarding its subject matter. Should any provision of this Agreement be held to be void or invalid, that fact will not affect any other provision, and the remainder of this Agreement will be construed to most closely give effect to the parties' intentions. Failure by Geavity to enforce any provision of this Agreement will not be deemed a waiver of future enforcement of that or any other provision. The interpretation and enforcement of this Agreement shall be governed according to international treaty provisions and other applicable laws.
   
   
   
10. LEGAL FEES
    
    If Geavity is obligated to go to court to enforce any of its rights, or to collect any fees, you agree to reimburse Geavity for its legal fees, costs and disbursements if Geavity is successful.
    
    
    
11. ASSIGNABILITY
    
    You may not assign or transfer to anyone else the rights granted to you in this Agreement, without our prior written consent.
    
    
    
12. ENTIRE CONTRACT
    
    YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTOOD IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND Geavity, WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATION BETWEEN YOU AND Geavity RELATING TO THE SUBJECT OF THIS AGREEMENT. THE EXPLANATIONS TO FAQ'S AND OTHER EXPLANATIONS AND CONTENT PROVIDED IN Geavity.COM WEBSITE ARE FOR YOUR INFORMATION ONLY AND ARE NOT, AND SHALL NOT BE CONSTRUED AS, PART OF THIS AGREEMENT.
    
    THIS AGREEMENT WAS ORIGINALLY COMPOSED IN ENGLISH AND WAS SUBSEQUENTLY TRANSLATED INTO OTHER LANGUAGES. THE FIDELITY OF SUBSEQUENT TRANSLATIONS CANNOT BE GUARANTEED. IN CASE OF CONFLICT BETWEEN THE ENGLISH VERSION AND ANOTHER LANGUAGE VERSION, THE ENGLISH VERSION TAKES PRECEDENCE.
